SysModeler, Inc. ("SysModeler", "we", "our", or "us") is committed to handling information responsibly and transparently. In that regard, this Privacy Policy explains how SysModeler processes information in connection with the use of its website and services. This document distinguishes between enterprise customers operating under a written contract and individual users accessing the Service without an enterprise agreement.
Nothing in this document limits SysModeler's ability to comply with applicable laws, regulations, lawful government requests, or obligations arising under separate agreements.

Enterprise Customer and Enterprise User
An "Enterprise Customer" is any organization, company, institution, or other legal entity that accesses or deploys SysModeler pursuant to a written "Enterprise Agreement" executed with SysModeler. An "Enterprise User" is any individual, including employees, contractors, consultants, or other authorized persons, who accesses the Service on behalf of an Enterprise Customer under such an "Enterprise Agreement". "Enterprise Customers" and "Enterprise Users" are collectively referred to as "Enterprise Users."
Individual User or Non-Enterprise User
An "Individual User" (also referred to as a "Non-Enterprise User") is any person who accesses or uses the "Service" without being covered by an "Enterprise Agreement."

Service
"Service" means SysModeler's website, web-based platform, modeling tools, AI-assisted features, integrations, and related services made available by SysModeler.
Enterprise Agreement
"Enterprise Agreement" means any written contract executed between SysModeler and an "Enterprise Customer" governing the use of the "Service", including any applicable Data Processing Agreement (DPA), schedules, addenda, or statements of work.

This Privacy Policy does not apply to third-party websites, tools, or services, even if accessed through our platform. Please go through the respective third party's privacy policy for details. Furthermore, except section 3 (which exclusively outlines privacy policy for enterprise customers), all the sections deal with non-enterprise individuals or trial users.
For organizations using SysModeler under an Enterprise Agreement, all data processing, security requirements, AI usage, storage practices, and access rules are defined entirely and exclusively by:

Any rights, obligations, or limitations for enterprise data arise solely from the contract, not this Privacy Policy.
We primarily collect three categories of data - the information provided by the user directly, information collected automatically while providing the service and information coming from third parties. Please note, we do not collect sensitive personal data (e.g., health, race) unless you voluntarily provide it.
We collect your name, email address, and any organizational or academic affiliation you provide when creating an account. We also collect your login credentials, profile settings, workspace preferences, and configuration choices. Additionally, we collect files, requirements, specifications, and documentation you upload to generate or edit system models, along with any SysML diagrams, saved projects, model revisions, and related metadata. Any comments, support messages, ratings, and any other feedback you provide to us are also collected.
SysModeler automatically collects certain technical and usage information to maintain platform performance and improve your experience.
This includes your modeling actions (such as edits, customizations, and responses to AI-generated outputs), as well as device information, browser type, operating system details, IP address, latency data, and diagnostic logs. We may also collect non-personalized engagement metrics such as session duration, click paths, modeling success rates, and feature usage, etc.
Analytics platforms
We may receive aggregated or anonymized usage insights from services like Google Analytics and Mixpanel to help us understand platform performance.
Authentication providers
If you sign in using services such as Google or GitHub, we receive your name, email address, and an authentication token to enable secure access.
Requirements management integrations
If you connect tools such as IBM DOORS, Jama, Jira, or Polarion, we may import requirement titles, descriptions, identifiers, dependencies, and related metadata into your workspace. This data is processed only according to your instructions.
Payment processors
Payments are handled by Stripe. Stripe collects and processes all credit card information on our behalf. SysModeler does not receive full payment card details; we only receive limited billing information such as payment status or the last four digits of your card for account management.
Integration controls
You may disconnect third-party integrations at any time. Previously imported data remains in your account under the same privacy terms.
We use the information we collect to operate SysModeler, provide modeling functionality, improve platform performance, and maintain a secure and reliable environment.
We use your uploaded content and project data to generate SysML diagrams, save your work, maintain workspace settings, and support the features you rely on.
As a core condition of using the Free and Trial tiers (including the paid "Extended Trial" tier) of the Service, the following data is collected and used to train and improve our AI models:
This processing is essential to delivering and continuously enhancing the AI features provided in the Free and Extended Trial tiers. For Enterprise customers, data usage is governed exclusively by the terms of your specific agreement.
By continuing to use the Free or Extended Trial Service, you acknowledge and consent to this data processing.
We use your preferences and usage behavior to tailor aspects of the platform, streamline workflows, and provide more relevant suggestions.
We use your contact information to send service-related notifications, account updates, and security alerts. We may also send you marketing communications or product announcements. You may opt out of marketing communications at any time by using the unsubscribe link in our emails or by contacting us directly.
Technical and diagnostic data helps us monitor platform health, troubleshoot issues, prevent unauthorized access, and maintain overall system reliability.
We may use your information to comply with legal obligations, respond to lawful requests, enforce our Terms of Service, or protect the safety and rights of SysModeler and its users.
We take data confidentiality seriously and limit sharing to what is necessary to deliver and improve the Service.
We do not share, sell, or disclose your modeling content for purposes unrelated to providing and improving the Service, unless you explicitly share it through collaboration features or we are legally compelled to do so.
For free-tier and non-enterprise users, SysModeler relies on trusted third-party large language model (LLM) providers (e.g., OpenAI, Google, etc.) to process your submitted data and deliver the Service's AI-assisted features. Their use of the data is governed by their respective terms and policies.
Additionally, we may share limited, non-model-related information (such as contact details or general usage patterns) with trusted service providers for purposes such as analytics, customer support, or marketing. We do not sell your personal information.
We may also disclose information when required to comply with applicable laws, regulations, or legal processes. Modeling data is never disclosed unless we are legally required and permitted to provide it.
We retain personal data for the duration of your account relationship and as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. We periodically review stored data and delete or anonymize personal data when it is no longer required for these purposes.

We take the security of your personal and project-related data seriously. Our website uses HTTPS encryption, and we maintain administrative, technical, and organizational safeguards to prevent unauthorized access, misuse, or disclosure. All user information and project data are stored in a secure cloud environment with strict access controls.
While we use industry-standard security measures, no method of electronic transmission or storage is entirely secure. You use the Service at your own risk.

SysModeler is headquartered in the United States. In connection with providing the Service, personal data of individual users may be processed or accessed from locations outside the user's country of residence. These locations may include jurisdictions where SysModeler's teams or service providers operate. Data processing activities are performed solely for the purposes described in this Privacy Policy.
The Service is not directed to children under the age required by applicable data protection law. SysModeler does not knowingly collect personal data from children.
